Con la sentenza impugnata, il Tribunale della funzione pubblica ha, anzitutto, constatato che il ricorso doveva essere considerato diretto soltanto avverso la decisione del 19 giugno 2007, in quanto, allorché un candidato di un concorso solleciti il riesame della decisione adottata dalla commissione giudicatrice, l’atto che gli arreca pregiudizio è costituito soltanto dalla decisione adottata da quest’ultima dopo il riesame della situazione del candidato (punti 19 e 20 della sentenza impugnata).
In the judgment under appeal, the Civil Service Tribunal noted, first, that the action must be held to be directed solely against the decision of 19 June 2007 on the ground that where a candidate in a competition seeks review of a decision taken by a selection board, it is the decision taken by the latter after the review of the candidate’s situation that constitutes the act adversely affecting him (paragraphs 19 and 20 of the judgment under appeal).
