La deroga è prevista all'articolo 14, paragrafo 1, primo comma nel quale si stabilisce che se in un determinato Stato membro la percentuale dei cittadini dell'Unione ivi residenti senza averne la cittadinanza e che hanno raggiunto l'età per essere elettori superi il 20% di tutti i cittadini dell'Unione ivi residenti e che hanno l'età per essere elettori, detto Stato membro, in deroga agli articoli 3, 9 e 10:
The first sub-paragraph of Article 14(1) states that if in a given Member State, the proportion of citizens of the Union of voting age who are residents but not nationals of it exceeds 20% of the total number of citizens of the Union residing there but who are of voting age, that Member State may, by way of derogation from Articles 3, 9 and 10:
