Secondo tale associazione la Deutsche Bahn abusa da vari anni della sua posizione di monopolio sul mercato dei servizi ferroviari in Germania per imporre, nel trasporto combinato effettuato dall'operatore specializzato Intercontainer, tariffe di trasporto ferroviario più basse per i movimenti di contenitori marittimi in transito nei porti tedeschi (Brema e Amburgo) rispetto ai porti belgi e olandesi, e questo al fine di avvantaggiare i propri servizi.
According to the complainant, Deutsche Bahn has for many years been using its monopoly on the market for rail services in Germany to impose cheaper rail transport tariffs, charged by the combined-transport operator Intercontainer, for the combined transport of sea-borne containers transiting through the German ports (Bremen and Hamburg) rather than through the Belgian and Dutch ports, so as to favour its own services.
